Who May Qualify for a Work Comp Waiver?
You may be eligible if you're self-employed or operate a business without employees.
Examples may include:
Sole proprietors with no employees other than the owner
Partnerships with no employees other than the partners
Certain LLC members when the business has no employees
Certain corporate directors or officers
Independent contractors who meet Utah's requirements and have no employees
Eligibility depends on your business structure and how you perform your work. Having a 1099 or simply calling yourself an independent contractor does not automatically mean you qualify.
Not sure if you qualify? That's okay. Fill out the form below and we'll help you determine your next step.
Why Am I Being Asked for a Work Comp Waiver?
If you're an independent contractor, subcontractor, or self-employed individual, a company hiring you may ask for proof of workers’ compensation insurance.
When you don't have employees and meet Utah's eligibility requirements, a Workers’ Compensation Coverage Waiver may be an alternative to purchasing a workers’ compensation policy for yourself.
This is especially common for contractors and subcontractors working on job sites where the hiring company needs to verify workers’ compensation coverage or waiver status for the people performing work.
A valid waiver can provide documentation that you have elected to waive workers’ compensation coverage for yourself.
